Subject to these terms and conditions (“Terms”), Eligible Customers will qualify to receive cashbacks in respect of Eligible Purchases made via Revolut during the Campaign Periods.

1. Why is this information important?

1.1.  These Terms govern the Paid Plans & Grocery Cashback Campaign (the “Campaign”), as well as the relationship between you and Revolut Technologies Singapore Pte. Ltd. (“Revolut”, “we,” “our” or “us”) in respect of the same.

1.2.  All decisions made by Revolut under these Terms shall be final. We may, but are not required to, justify any of our decisions. Only you and us have any rights under these Terms - they are personal to you and you cannot transfer any rights or obligations to anyone else.

2. What is the duration of the Grocery Cashback Campaign?

2.1. The Campaign is split into two (2) tranches of separate (and independent) participating periods, namely: (a) from 1 October 2021 to 31 October 2021; and (b) from 1 November 2021 to 30 November 2021 (“Second Campaign”)(each a “Campaign Period” and collectively, the “Campaign Periods”).

3. Am I eligible to participate?

3.1.  Only Eligible Customers can participate and receive any cashback. An “Eligible Customer” is a customer of Revolut who fulfils the following criteria (at all times) throughout the entire Campaign Periods until five (5) business days after cashback is paid out in respect of the Second Campaign:

(a)  has an active account (not suspended or restricted in any way);

(b)  has personally received an email from Revolut inviting him/her to participate in this Campaign ( the “Email Invitation”);

(c)  is in compliance with these Terms and applicable laws; and

(d)  is currently legally residing in Singapore.

3.2.  Only persons who are on Revolut Standard Plans as of the date of the Email Invitation will be Eligible Customers.

3.3.  You will be deemed to be participating in the Campaign: (i) if you are an Eligible Customer and fail to reach out to us via the in-app chat to inform us that you do not wish to participate in the Campaign within five (5) business days of receiving any cashback (as deposited in your Revolut Account); and (ii) if you fail to refund us the said cashback within five (5) business days of our request (by whatever means specified by us).

3.4. By participating in the Campaign, you:

(a)  confirm that you have read, understood and agreed to be bound by these Terms, including any later amendments and modifications thereto;

(b)  warrant and represent that all details that you provide about yourself, are true, accurate and complete, including the fact that you are and remain an Eligible Customer;

(c)  warrant and undertake that you are and will be in compliance with all applicable laws, as well as all other applicable Revolut terms and conditions that you are subject to;

(d)  warrant and undertake that you have acted and will act in accordance with principles of good faith and honesty; and

(e)  hereby agree to indemnify and hold us harmless in the event you breach these Terms or applicable laws.

3.5.  Eligibility will be determined at our sole discretion. We have the right to disqualify you at any time, if we discover you have breached these Terms, applicable laws or are not an Eligible Customer.

3.6.  In the event that Revolut (in its sole discretion) believes that you have breached these Terms, applicable laws, or are not an Eligible Customer at anytime, you hereby undertake and warrant (on a continuing basis) that you will immediately refund any cashbacks provided to you to us (under these Terms) within three (3) business days of our request (by whatever means we specify), failing which, you hereby unequivocally authorise us to deduct the same from your Revolut account without further notice.

3.7.  Employees and contractors of Revolut and their immediate family members (spouses, parents, children, siblings and their respective spouses, regardless of where they live) or persons living in the same households, whether or not related, are not eligible to participate in this Campaign.

4. How do I earn cashback and how much can I earn?

4.1.  Subject to these Terms, an Eligible Customer can earn cashback by performing both the following (in chronological order):

(a)  successfully upgrading his/her existing (Standard) Revolut subscription plan (“Plan”) from the date of receiving his/her Email Invitation to 7 October 2021 11:59 pm (“Plan Upgrade”); and

(b)  using his/her upgraded Revolut account to pay for Eligible Purchases during the Campaign Period(s).

4.2.  Your existing Plan will only be considered as “successfully upgraded” once you receive an email confirming this (without any restrictions or further information outstanding).

4.3.  The amount of cashback you stand to earn depends on the type of Plan Upgrade you make as well as the aggregate value of Eligible Purchases that you make (subject to a cap), per the table below:

(For example, this means that if you upgrade from a Standard to Metal Plan and spend SGD $200 on Eligible Purchases within a Campaign Period, the maximum amount of cashback you will receive is SGD $40 for that Campaign Period. Alternatively, if you spend SGD $100 instead, the maximum amount of cashback you will receive is SGD $20.)

4.4. For the avoidance of doubt and notwithstanding anything to the contrary:

(a) the maximum amount of cashback that you stand to receive is the percentage value in column “B” above multiplied by the aggregate amount of Eligible Purchases made in each Campaign Period (subject to the caveat that the latter is capped at the relevant figure in column “C” above);

(b) the minimum amount of cashback that an Eligible Customer can receive in respect of each Campaign Period is SGD $0.10 This means that no cashback will be awarded if the participating Eligible Customer’s cashback entitlement is less than this amount.

5. What are Eligible Purchases?

5.1.  “Eligible Purchases” mean online and offline purchases from merchants using the Revolut card

or Revolut app, where:

(a)  the merchant’s category code (“MCC”) is designated as MCC 5411;

(b)  the specific transaction is recorded under the same MCC; and

(c)  such merchants are Singapore-based and Singapore-incorporated.

5.2.  For the avoidance of doubt:

(a)  any purchases made before the Eligible Customer performs the Plan Upgrade will not be “Eligible Purchases”; and

(b)  Revolut is not responsible for designating MCCs and has no control over the same. As such, while merchants with MCC 5411 are typically grocery stores and supermarkets, we are unable to guarantee this is always the case, or whether the specific transaction is classified as a purchase recorded as being under MCC 5411. You acknowledge and agree that we are not responsible for providing you with any advice on whether a purchase is/will be an Eligible Purchase and/or regarding MCC codes. You additionally agree any advice/comments on the foregoing received from us or our representatives shall not be binding on us with respect to this Campaign; and

(c)  if you make an Eligible Purchase and any refund or chargeback is subsequently applied in respect of it, it will no longer be considered an Eligible Purchase.

6. How do I know if I’ve been awarded any cashback and how do I collect this?

6.1. Revolut will contact all Eligible Customers who have been awarded cashbacks by email and deposit the cashback amounts into their Revolut accounts within ten (10) business days after the end of each Campaign Period. Any cashback amounts awarded can only be deposited into the Eligible Customer’s Revolut account, and are personal, non-transferable, non-assignable, non-exchangeable.

7.1. You participation in the Campaign is subject to these Terms as well as the all other terms and conditions that apply to you as a customer of Revolut (in accordance with your Plan at any point of time), including:

these Terms incorporate the same by reference. In the event of any conflict, these Terms will prevail to the extent of the inconsistency.

7.3.  Revolut will not be responsible for technical errors in telecommunications networks, internet access or circumstances otherwise preventing or causing a delay in participation. This includes but is not limited to situations where participants may attempt to upgrade their Plan within the prescribed period, but where Revolut does not approve the same.

B. No fraud, bad faith, abuse of the Campaign or violation of terms

7.4.  Revolut reserves the right at any time to:

(a)  to refuse participation, disqualify or to refuse to award any cashback to you if you are found to be in breach of these Terms or the law. Further, we reserve the right to clawback any cashback or benefit issued as part of the Campaign in case of any fraudulent, dishonest and inappropriate––as deemed solely by us––activities related to this Campaign.

(b)  request for further details evidencing your eligibility and compliance with these Terms or applicable laws, to verify the accuracy of your details, to request for supporting proof of identification, and to disqualify any participant who has not participated in accordance with these terms, acts in bad faith, or who tampers or tries to subvert the Campaign.

7.5.  If we have reasonable grounds to believe that you have engaged in any fraud, bad faith or material abuse of this Campaign (such as for example, attempting to obtain an unfair advantage through deception) we may in our sole discretion take any actions we see fit in the circumstances.

7.6.  Without prejudice and in addition to anything in these Terms, if you close your Revolut account, downgrade your Plan or withdraw from the agreement to upgrade your Plan at any time before payout is made by us at after the end of the Second Campaign, you:

(a)  will automatically be disqualified from participating in the Campaign and forfeit the right to any cashback; and

(b)  agree and hereby hereby undertake and warrant (on a continuing basis) to immediately refund to us any cashbacks provided, within three (3) business days of our request (by whatever means we specify), failing which, you hereby unequivocally authorise us to deduct the same from your Revolut account without further notice.

C. Change of Cashback Campaign Terms and Termination

7.7. Revolut reserves the right to change, modify and/or supplement these Terms, and to modify, cancel or suspend the Campaign at its sole discretion at any time, and these shall be immediately effective and have retrospective effect. We reserve the right, at any time in our sole and absolute discretion, to substitute, withdraw, add to or alter any of the cashbacks offered without notice. Substitutions may not be of equal value. Notice of the foregoing (if any) will be posted on our website and/or notified to you by in-app notifications or email. Examples of situations where we might exercise this discretion include but are not limited to circumstances where in our reasonable opinion, the Campaign is being abused, which may negatively affect Revolut’s goodwill or reputation or due to legal reasons.

7.8. Revolut shall not be responsible or liable for any failure or delay in rendering any cashbacks arising in any way due to a participant's act/omission, caused (directly or indirectly) by things beyond its reasonable control or by third parties. Accordingly, Revolut will not be liable for any loss, whether directly or indirectly suffered, as a result of or in connection with the foregoing.

D. Limitation of liability

7.9.  Participation in this Campaign is entirely at your own risk. We exclude all warranties and representations in connection with the same to the furthest extent permitted by law.

7.10.  We will not be liable for any loss (including, without limitation, indirect or consequential loss) in connection with the Campaign or any cashback, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

7.11.  We accept no responsibility for any tax or other liability that may arise in relation to the cashbacks (including but not limited to goods and services tax).

7.12.  To the extent that Revolut suffers any claim, loss, damage or judgement due to your actions or omissions (including, but not limited to, your participation in the Campaign or breach of any of these Terms by you), you hereby agree to indemnify and hold Revolut and its respective officers, employees and agents harmless.

E. Right to enforce/ Governing Law

7.13.  Singapore law shall apply. Any disputes arising out of or in connection with these terms shall exclusively be submitted to and dealt with by the exclusive jurisdiction of Singapore courts.

7.14.  No waiver, delay or failure on our part to enforce any of our rights (whether under contract, statute, general law or equity) in full or in part, shall constitute a waiver of that or any other right.

7.15.  A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce the same.

F. Personal Data

7.16.  By participating in this Campaign you consent to Revolut’s, collection, holding, storage use, processing, transfer, disclosure and/or reporting (directly or indirectly) of your personal data to relevant third parties (including any persons who are involved in operating, administering or promoting this Campaign on behalf of Revolut), including but not limited to for the purposes of administering this Campaign, for contacting you regarding the same and for marketing this Campaign.

Save for the above, personal data relating to Revolut customers are kept confidential and will otherwise not be given to any other person except with the consent of the Revolut customer or as permitted by the Personal Data Protection Act 2012 (and subsidiary legislation).
