Terms and Conditions – Revolut E-Hongbao Bonanza

  1. What is the Revolut E-Hongbao Bonanza about?

Subject to the terms and conditions (“Terms”) contained in this document, the Revolut E-Hongbao Bonanza consists of the following:

(a) opportunities to win multiple cash gifts of up to SGD $18 each (“Cash Gifts”); and

(b) an opportunity to win one of the following prizes: (i) SGD $4,888; (ii) SGD $2,688; (iii) SGD $1,288; or (iv) a discount code for cleaning services by Helpling Singapore Pte. Ltd. (“Helpling”) worth SGD $400; (“Prizes” or “Lunar New Year Lucky Draw”).

2. What is the duration of the Revolut E-Hongbao Bonanza?
The participating period for the Revolut E-Hongbao Bonanza will run from 1st to 28th February 2021, inclusive (“Participating Period”). We reserve the right to alter the Participating Period at any time.

3. Why is this information important?

3.1 These Terms govern the relationship between each participant in the Revolut E-Hongbao Bonanza (“Participant” or “you”) and Revolut Technologies Singapore Pte Ltd (“Revolut”, “we,” “our” or “us”).

3.2 You will be deemed to be participating in the Revolut E-Hongbao Bonanza whenever you send an e-hongbao to persons who are not existing customers of Revolut, during the Participating Period, unless you notify us in writing otherwise. An “e-hongbao” is money transmitted by you to another individual under the “Gift” icon of the “Revolut Marketplace”, which is subject to the intended recipient’s confirmation of acceptance.

3.3 By participating in the Revolut E-Hongbao Bonanza and/or accepting any Prize or Cash Gift (whenever applicable):

a) you confirm that you have read, understood and agreed to be bound by these Terms, including any later amendments and modifications thereto;

b) you warrant and represent that all details that you provide about yourself, are true, accurate and complete, including your eligibility to participate; and

c) you warrant, represent and undertake that with respect to any personal data provided to us by you in connection with the Revolut E-Hongbao Bonanza:

(i) you have complied with all applicable laws (especially those relating to personal data);

(ii) you have obtained the consent of the individual whose personal data you provided us; and

(iii) the personal data of such individuals as provided to us is true, accurate and complete,

and hereby indemnify us in the event of any breach by you.

3.4 All decisions made by Revolut under these Terms shall be final. Revolut may, but is not required to, justify any decisions relating to the Revolut E-Hongbao Bonanza.

3.5 Only you and we have any rights under these Terms. These Terms are personal to you and you cannot transfer any rights or obligations under them to anyone else.

4. Who is eligible to participate in the  Revolut E-Hongbao Bonanza?

4.1 In order to win any Cash Gift, Prize or benefit from the Revolut E-Hongbao Bonanza, you must be an Eligible Customer of Revolut. An “Eligible Customer” is a customer of Revolut who fulfils all the following criteria:

a) has downloaded the Revolut app;

b) has successfully set up an account with Revolut (whether as a Standard, Premium or Metal customer);

c) is currently legally residing in Singapore;

d) is not an existing employee or contractor of Revolut; and

e) is not an employee/contractor of vendors, advertising agencies of Revolut and/or any other third party, which has been directly involved in organising, promoting, sponsoring or conducting the Revolut E-Hongbao Bonanza.

4.2 For the avoidance of doubt, employees and contractors of Revolut and their immediate family members (spouses, parents, children, siblings and their respective spouses, regardless of where they live) or persons living in the same households, whether or not related, are not Eligible Customers.

4.3 Revolut will determine eligibility at its sole discretion, and may forfeit Cash Gifts or Prizes in the event we discover that you have breached these Terms or are (or are no longer) an Eligible Customer.

5. How do I get Cash Gift(s)?

5. 1 To be awarded Cash Gifts of up to SGD $18 each, you must:

a) send e-hongbaos to individuals residing in Singapore who currently do not hold an account with Revolut (please note that instructions given past 4pm on a Business Day will be deemed to have been given the next Business Day);

b) ensure that a minimum of three (3) of your intended recipients (as referred to in (a)), fulfil the following criteria in full:

(i) apply for and be approved as a Revolut account holder by 28th February 2021 11:59pm (Singapore time) (failing which your instructions to us to execute the e-hongbao on your behalf will lapse and we will not be able to fulfil the same); and

(ii) make their first spend (by making a purchase via their Revolut account) within 28 calendar days of their Revolut account being approved by us,

(for convenience, any intended recipient who fulfils the criteria in clause 5.1 shall be referred to as  a “Qualified Recipient”).

5.2 Subject to these Terms, you will be able to receive one (1) Cash Gift for every three (3) Qualified Recipients. In other words, you may receive multiple Cash Gifts. We will contact you via the email address linked to your account by 6th April 2021 to inform you of the number and value of Cash Gifts you qualify for. Unless you notify us in writing otherwise within thirty-six (36) hours, you will be deemed to have accepted the Cash Gift(s). Subject to the foregoing and our right to require additional proof or verification of your identity, we will deposit the equivalent amount of Cash Gift into your Revolut account by 13th April 2021.

5.3 All Cash Gifts awarded to you are subject to these Terms. By accepting a Cash Gift, you understand and agree that:

a) acceptance of any Cash Gift, shall constitute consent on your part to allow the use of the your name by Revolut for editorial, advertising, promotional, marketing and/or other purposes without further compensation or notice to you except where prohibited by law;

b) acceptance of any Cash Gift, shall constitute consent on your part to being contacted by us, and providing us with testimonial, photos, feedback and/or quotes for the purposes mentioned in (a); and

c) no compensation or further notice shall be provided to you in respect of (a) and (b), except where required by law.

5.4 When sending an e-hongbao, you are responsible for entering accurate and complete details of every intended recipient, and for the consequences of any errors on your part. Revolut accepts no responsibility for any instructions to us that are not received, delayed, misdirected or not delivered for any reason, nor is responsible for your intended recipient’s ability and/or willingness to fulfil clause 5.1 (including but not limited to KYC). We will not be responsible for technical errors in telecommunications networks, MyInfo, internet access or circumstances otherwise preventing the intended recipient from receiving an e-hongbao (including where he/she misses the relevant timeframes within which to become a Qualified Recipient).

5.5 For the avoidance of doubt, once your intended recipient has been approved as a Revolut account holder, he/she will need to indicate his/her acceptance of your e-hongbao via the Revolut Dashboard, in order to receive the e-hongbao. Should the intended recipient fail to accept the e-hongbao from you after six (6) months, the relevant funds will revert back to you.

5.6 All personal data submitted about you and your intended recipients must be legally accurate and complete. The use of aliases is prohibited. Revolut reserves the right, at any time, to verify the validity of entries and the accuracy of any persons details, to request for supporting proof, and to disqualify any e-hongbaos not submitted in accordance with these terms or which tampers or tries to subvert the Revolut E-Hongbao Bonzana. This includes, but is not limited to, situations where we suspect that you or the intended recipient/Qualified Recipient have submitted false, outdated, inaccurate or incomplete information.

5.7 Revolut reserves the full discretion to forfeit or clawback any Cash Gift awarded to you (in whole or in part) at any time, where it has reasonable grounds for believing that you have contravened any of these Terms, committed fraud, acted in bad faith (whether independently or in concert with others), or are otherwise in breach of the law or our internal policies. You agree and authorise us to conduct such clawback by way of set-off, failing which you undertake to pay back the monies to us upon demand.

6 How do I participate in the Lunar New Year Lucky Draw and what will I win?

6.1 You will automatically be deemed to be participating in the Lunar New Year Lucky Draw provided you have sent e-hongbaos to a minimum of three (3) Qualified Recipients and spent a minimum of SGD $355 (on an accumulated basis) on your own Revolut Account, on goods/services online or in-store, within the ParticipatingPeriod. This will constitute one (1) entry into the Lunar New Year Lucky Draw.

6.2  Further and in addition to the above:

a) provided clause 6.1 is fulfilled, every additional three (3) Qualified Recipients that you send e-hongbaos to, will entitle you to one (1)  additional entry into the Lunar New Year Lucky Draw; and

b) provided the minimum spend of S$355 on your own Revolut Account is met (per clause 6.1), you will be entitled to two (2) entries in the Lunar New Year Lucky Draw for every three (3) Qualified Recipients that you send e-hongbaos to, on “Lucky Draw Double Chance Days”. “Lucky Draw Double Chance Days” are 11th, 12th, 13th, 14th and 26th February 2021.

6.3 Participants stand a chance to win one (1) of the following prizes:

  1. SGD $4,888;
  2. SGD $2,688;
  3. SGD $1,288;
  4. one (1) of two (2) discount codes (worth SGD $400 each and expiring on 31st December 2021) from Helpling for cleaning services per https://www.helpling.com.sg/spring-cleaning (“Helpling Discount Codes”).

6.4 Revolut will select the winners of the  Lunar New Year Lucky Draw (“Winners”) based on random selection within the entries recieved. We will contact all Winners via the email address linked to their Revolut account by 6th April 2021. Each Winner must respond to such email with a written acknowledgement and indicate acceptance of their Prize within 36 hours of receiving the same. In the event that Revolut does not ––for any reason––obtain a Winner’s acknowledgement within 36 hours of first attempting to do so, we reserve the right to select an alternative Winner or to forfeit the Prize at our sole discretion. Subject to the foregoing and our right to require additional proof or verification of your identity, we will deposit cash Prizes into the respective Winner’s Revolut Account or provide the Helpling Discount Code by 16th April 2021.

6.5 Revolut reserves the right to select an alternative Winner at any time, where it has reasonable grounds for believing that the initially selected Winner has contravened any of these Terms, committed fraud, acted in bad faith (whether independently or in concert with others), or is otherwise in breach of the law or any of our internal policies. Any alternative Winners will be selected applying the same method used to select the original Winner.

6.6 You understand and agree that:

a) acceptance of any Prize, shall constitute consent on the Winner’s part to allow the use of the Winner’s name by Revolut for editorial, advertising, promotional, marketing and/or other purposes without further compensation or notice to the same except where prohibited by law;

b) acceptance of any Prize, shall constitute consent on the Winner’s part to being contacted by us and providing us with testimonial, photos, feedback and/or quotes for the purposes mentioned in (a); and

c) no compensation or further notice shall be provided to the Winners in respect of (a) and (b), except where prohibited by law.

6.7 For the avoidance of doubt:

a) any monetary Prizes awarded can only be deposited into the Winner’s Revolut account, and are personal to the Winners, non-transferable, non-assignable, non-exchangeable, and cannot be redeemed for cash (in the case of the Helpling Discount Codes);

b) no one may win more than one (1) prize in the Lunar New Year Lucky Draw. In the event that the Lunar New Year Lucky Draw random draw results in your name being selection  for more than one (1) Prize, you agree that that the Prize of lesser value will automatically be forfeited;

c) Winners who win, accept and/or use a Helpling Discount Code:
(i) acknowledge and agree that the value of the Helpling Discount Code will only cover relevant cleaning services for apartments less than 1,300 square foot in size, and that the Winner may need to pay additional fees for apartments above that size or for services that fall out of scope (https://www.helpling.com.sg/spring-cleaning);

(ii) consent and authorise Revolut to release his/her name, email address and telephone number to Helpling for the purpose of facilitating his/her collection and use of the Helpling Discount Code (Helpling will also reach out to such Winners), and acknowledges that Helpling’s privacy policy will apply once the personal data is released to Helpling (see https://www.helpling.com.sg/privacypolicy);

(iii) acknowledge that use of the Helpling Discount Code is subject to Helpling’s applicable terms and conditions, that Revolut has no control or oversight over the same and makes no warranties or representations regarding Helpling’s services. Further to this, the Winners agree that Revolut shall bear no liability beyond providing them with the Helpling Discount Code, and hereby indemnify and agree to hold Revolut harmless against any damage or claims involved;

(iv) acknowledge and agree that Winners will need to open a Helpling account in their own name (in order to apply the Helpling Discount Code), that the Helpling Discount Code is not transferable or redeemable for cash;

7 What else should I know?

A. Other applicable terms and conditions

7.1 You acknowledge that your participation in the Revolut E-Hongbao Bonanza is subject to these Terms as well as the other terms and conditions applicable to all Revolut cardholders, and incorporates the same by reference, including:

a) General Terms at https://www.revolut.com/en-SG/legal/terms;

c) Metal Terms at https://www.revolut.com/en-SG/legal/premium-and-metal;

d) Fees Terms at https://www.revolut.com/en-SG/legal/metal-fees

e) Privacy Policy at https://www.revolut.com/en-SG/legal/privacy; and

f) Website Terms at https://www.revolut.com/en-SG/legal/website-terms,

as well as all other terms referenced by the foregoing. In the event of any conflict, these Terms will prevail to the extent of the inconsistency.

B. No fraud or violation of terms
7.2 Revolut reserves the right to refuse participation, or to refuse to award any benefits to any participant in breach of these Terms, its internal policies or the law. Further, we reserve the right to clawback any benefit issued as part of the Revolut E-Hongbao Bonanza in the event of any fraudulent, dishonest and inappropriate––as deemed solely by us––activity/conduct and/or rigging related to the same. Such activities may include setting up an account using a third party’s information without consent, and other malicious actions. You agree that we may conduct a clawback by way of setting off against your Revolut account, and further in alternative, to transfer such sums of money upon demand.

C. Change of Contest Terms and Termination

7.3 Revolut reserves the right to change, modify and/or supplement the Terms from time to time, and to modify, cancel or suspend the Revolut E-Hongbao Bonanza at its sole discretion at any time, and these shall be immediately effective and have retrospective effect. Notice of the foregoing (if any) will be posted on our website. Examples of situations where we might exercise this discretion include but are not limited to circumstances where in our reasonable opinion, the Revolut E-Hongbao Bonanza is being abused, which may negatively affect Revolut’s goodwill or reputation or due to legal reasons.

7.4 We also reserve the right, at any time in our sole and absolute discretion, to substitute, withdraw, add to or alter any of the Prizes and/or Cash Gifts offered without notice. Substitutions may not be of equal value.

7.5 Revolut shall not be responsible or liable for any failure or delay in rendering any Prizes or Cash Gift arising in any way from a Winner’s conduct, or caused (directly or indirectly) by forces beyond its reasonable control or by Helpling. Accordingly, Revolut will not be liable for any loss, whether directly or indirectly suffered, as a result of or in connection with the foregoing.

D. Limitation of liability
7.6 All Prizes and Cash Gifts are accepted entirely at the risk of the Winner and participants to the Revolut E-Hongbao Bonanza. Revolut excludes all warranties in connection with the same to the furthest extent permitted by law.

7.7 Revolut shall not be liable for any loss (including, without limitation, direct, indirect or consequential loss) in connection with the Revolut E-Hongbao Bonanza or any Prize/Cash Gift, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

7.8 We accept no responsibility for any tax or other liability that may arise from the prizes (including but not limited to goods and services tax).

7.9 To the extent that Revolut suffers any claim, loss, damage or judgement due to your actions or omissions (including, but not limited to, your participation in Revolut E-Hongbao Bonanza or breach of any of these Terms), you agree to indemnify and hold Revolut and its respective officers, directors, employees and agents harmless.

E. Governing law and courts

7.10 These Terms shall be governed and construed in accordance with the laws of Singapore. Any disputes arising out of or in connection with these terms shall exclusively be submitted to and dealt with by the exclusive jurisdiction of the competent court in Singapore.

F. Our right to enforce

7.11 If you have breached the Terms and we do not enforce our rights, or we delay in enforcing them, this will not prevent us from enforcing those or any other rights at a later date.

7.12 A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce the same.

G. Personal Data

7.13 By participating in the Revolut E-Hongbao Bonanza, you consent to Revolut’s, collection, holding, storage use, processing, transfer, disclosure and/or reporting (directly or indirectly) of your personal data to relevant third parties (including Helpling and/or any other persons who are involved in operating, administering or promoting the Revolut E-Hongbao Bonanza on behalf of Revolut), including but not limited to for the purposes of administering the and for contacting you regarding the Revolut E-Hongbao Bonanza and for marketing purposes. You undertake and warrant to procure the consent of any person whose personal information is provided to us by you.

7.14 You can find more information about how we use your personal data in our Privacy Policy (available at www.revolut.com/en-SG/legal/privacy). Save for the above, personal data relating to Revolut customers are kept confidential and will otherwise not be given to any other person except in accordance with these Terms; with the consent of the Revolut customer; or as permitted by the Personal Data Protection Act 2012 (and subsidiary legislation).
